In January 2024, after presenting a comprehensive mitigation package, our client received a two-year suspended prison sentence, which included 180 hours of community service which is a significantly favourable outcome given the severity of the case.
More recently, the financial recovery proceedings under the Proceeds of Crime Act (POCA) concluded. The prosecution initially sought a confiscation order exceeding £1.4 million, but following extensive negotiations, we successfully reduced this to less than £900,000 – an amount already frozen in company bank accounts. Crucially, our client was able to retain his matrimonial home despite the aggressive stance taken by the authorities.
This case serves as a stark reminder that regulatory bodies are actively pursuing POCA confiscation proceedings. Notably, the authorities sought to include the value of our client’s shares in a separate, legitimate business (in which he was the sole shareholder) as part of the realisable amount. However, by challenging the valuation method, we saved our client over £80,000 – an important legal argument with wider implications.
